1. About these Terms
Welcome to DraftFork. These Terms of Service ("Terms") are a binding agreement between you ("you") and DraftFork ("DraftFork", "we", "us", or "our") and govern your access to and use of the website at draftfork.com and all related tools, features, and services (together, the "Service"). By accessing or using the Service, creating an account, or purchasing a subscription, you agree to these Terms. If you do not agree, please do not use the Service. By using the Service you confirm that you are able to enter into a legally binding contract.

2. What DraftFork Is
DraftFork is an AI-assisted writing tool that helps you rewrite, refine, and improve text so that it reads more naturally and in your own voice. DraftFork is a writing aid only. It is designed to help you with your own legitimate writing — it is not a service for producing work to be passed off dishonestly, and it does not replace your own judgement, review, or authorship. You decide what to write, and you are responsible for the final text you produce and how you use it.

3. Acceptable Use and Your Responsibilities
You agree to use the Service lawfully, honestly, and only for purposes you are permitted to use it for. You are solely responsible for the text you submit, for the output you generate, and for how you use it.

You must not use the Service to:

  • engage in academic dishonesty, cheating, plagiarism, or to misrepresent AI-assisted or third-party work as your own where doing so is prohibited. You are responsible for complying with the rules and policies of any school, university, employer, publisher, platform, or other body you submit work to, and for any consequences of failing to do so;
  • deceive, defraud, impersonate, or mislead others, or evade rules, detection, or moderation systems for any unlawful or deceptive purpose;
  • create or distribute content that is illegal, harmful, hateful, harassing, defamatory, sexually exploitative, or that infringes anyone's rights;
  • violate the usage policies of the third-party AI providers that power the Service (including, for example, OpenAI, Anthropic, and Google), which also apply to your use;
  • abuse, overload, scrape, reverse-engineer, resell, or share access to the Service, or attempt to bypass usage limits or security measures.

Your use is also subject to our Fair Use Policy, which is incorporated into these Terms by reference. We may suspend or terminate accounts that breach this section.

4. No Guarantee of Results or "Undetectability"
The Service uses automated systems and will not always be perfect. We do not guarantee that output will be accurate, original, error-free, suitable for any particular purpose, or that it will pass, bypass, or evade any AI-detection tool, plagiarism checker, or similar system. AI-detection technology changes constantly and is outside our control. You are responsible for reviewing, editing, and verifying any output before you rely on or publish it.

5. Your Content and Ownership
You keep ownership of the text you submit ("Input") and, as between you and us, of the text the Service returns to you ("Output"). You grant us a limited licence to process your Input and Output as needed to operate and provide the Service, including by sending it to the third-party AI providers that power DraftFork. We do not claim ownership of your Input or Output and we do not sell it. You are responsible for ensuring you have the rights to the Input you submit, and you accept that Output may not be unique and that similar Output may be generated for other users.

6. Accounts
You access the Service by signing in (for example, with Google). You are responsible for keeping your account secure and for all activity that happens under it. You agree to provide accurate information and not to share your account or use someone else's.

7. Subscriptions, Billing and Auto-Renewal
Some features require a paid subscription. By subscribing, you agree to the plan you select and to be charged on a recurring monthly basis. Your subscription automatically renews each month and you will be charged the then-current price until you cancel. Payments are processed through Shopify, and your prices may be shown and charged in your local currency. Each billing cycle, your plan's credits are refreshed to your plan's monthly allowance — unused credits do not roll over and are not cumulative. We may change plan features or pricing, and we will give you reasonable notice of price changes before they take effect; continuing your subscription after a change means you accept the new price. You are responsible for any applicable taxes.

8. Cancellation
You can cancel your subscription at any time — immediately — either through your account on the website or by emailing us at info@draftfork.com, and we will cancel it for you right away. When you cancel, your subscription ends immediately: you will not be charged again, your plan returns to free, your remaining paid credits are set to zero, and access to paid features ends at once, even if time remained in your billing cycle. Cancelling stops future charges; it does not by itself create a right to a refund of amounts already paid (see Refunds below).

9. Refunds
Your satisfaction matters to us. Subscription charges are generally non-refundable, and we do not automatically refund unused time or credits. However, if you are not happy with DraftFork, please email us at info@draftfork.com and tell us why. If you have not used a significant portion of your monthly credits and your request is reasonable, we will do our best to make it right — including, where appropriate, issuing a refund. All refund requests are considered individually and granted at our sole discretion; this section does not create a guaranteed right to a refund.

If you are a consumer in the EU, EEA, or UK, you may have a statutory right to withdraw from a purchase of digital services within 14 days. By subscribing and beginning to use DraftFork (including generating any Output or using any credits), you expressly request that we begin providing the Service immediately and you acknowledge that you lose this right of withdrawal once the Service has begun. Where you have not yet used the Service, you may withdraw within 14 days by emailing info@draftfork.com. Nothing in these Terms removes any mandatory consumer rights you have under the law of your country of residence.

10. Fair Use Policy
To keep DraftFork fast, fair, and available to everyone, your use is subject to our Fair Use Policy, which sets out usage limits and anti-abuse rules and forms part of these Terms.

11. Privacy and Data
We care about your privacy. To keep the Service secure and to prevent automated abuse, we collect technical information such as your IP address and device and browser signals, and we use it for security, bot-prevention, and rate-limiting purposes. We do not sell this information or share it with third parties, and we do not use it for any purpose other than operating and protecting the Service. Our full Privacy Policy explains what we collect and how we handle it, and forms part of these Terms.

12. Third-Party Services
DraftFork relies on third-party services, including Shopify (checkout and payments), AI providers that generate output, and sign-in providers such as Google. Your use of those services may be subject to their own terms, and we are not responsible for them. We are not affiliated with, and do not control, any AI-detection or plagiarism tool.

13. Our Intellectual Property
The DraftFork name, website, software, design, and content are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-exclusive, non-transferable right to use the Service in line with these Terms. You may not copy, modify, resell, or create derivative works from the Service or our brand without our permission.

14. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

15. Limitation of Liability
To the fullest extent permitted by law, DraftFork will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, or for any consequences arising from how you use the Output. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited by law, including your mandatory consumer rights.

16. Indemnification
You agree to indemnify and hold harmless DraftFork from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your Input or Output, your use of the Service, your breach of these Terms, or your violation of any law or the rights of any third party.

17. Suspension and Termination
We may suspend or terminate your access to the Service at any time if you breach these Terms, misuse the Service, or where we reasonably need to in order to protect the Service or other users. You may stop using the Service at any time by cancelling your subscription and discontinuing use.

18. Changes to the Service and these Terms
We may update, change, or discontinue parts of the Service, and we may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

19. Governing Law and Disputes
These Terms are governed by the laws of the country or state in which you reside, and any dispute will be handled under those laws. If you are a consumer, you keep the benefit of any mandatory protections of your local law and may bring proceedings in your local courts where the law gives you that right. Before bringing any formal claim, please contact us first at info@draftfork.com so we can try to resolve the matter informally.

20. General
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms (together with the Fair Use Policy and Privacy Policy) are the entire agreement between you and us regarding the Service. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition, or sale of assets. Our failure to enforce any provision is not a waiver of it. We are not liable for delays or failures caused by events beyond our reasonable control.
